CMS released the final Medicaid Access Rule (CMS-2442-F). This rule will significantly impact Medicaid home and community-based services (HCBS). 

The regulation becomes “effective” on July 9, 2024.  There are a number of provisions though that do not actually take effect until several years after the effective date of the rule. 

The final rule continues to require that 80% of Medicaid payments for three specific services be paid to direct care workers as compensation but includes some changes from the   notice of proposed rule.
